CRIMINAL LAW, CAPITALISM AND STATE: CRITICAL REFLECTIONS

RESUMO

O presente artigo tem por objetivo fazer uma análise crítica do direito penal e do Estado moderno a partir de aspectos econômicos e sociais. O marco histórico mais relevante decorreu da consolidação dos meios de produção capitalista e com a difusão das ideias iluministas, em que o direito penal sofreu profundas modificações, pois, diante das novas formas de sociabilidade, não se admitia mais punições como as ocorridas no sistema feudal. O direito penal, portanto, foi obrigado a se adaptar às novas concepções jurídicas, políticas e sociais. Com efeito, é impossível uma reflexão acerca do direito penal sem contextualizá-lo com o Estado, tendo em vista que é, por meio deste último, com todo o seu aparato judicial, que aquele se legitima. O sistema econômico vigente é um importante fator de reflexão dentro do contexto da criminalidade, principalmente com o avanço das políticas neoliberais e da globalização. Os aspectos econômicos e políticos, aliados à atuação mínima do Estado nas questões sociais e máximas para o capital, têm contribuindo fortemente para a expansão do Estado penal.

ABSTRACT

This article aims to make a critical analysis of criminal law and the modern state from economic and social aspects. The most important milestone resulted from the consolidation of the capitalist means of production and the diffusion of Enlightenment ideas in the criminal law has undergone profound changes since before the new forms of sociability, not more punishment admitted which occurred in the feudal system . The criminal law thus was forced to adapt to new legal concepts, political and social. It is impossible for a reflection on the criminal law without contextualizing it with the State in order that by the latter, with all its judicial system, that this is legitimate. The current economic system is an important factor for consideration within the context of crime, especially with the advance of neoliberal policies and globalization. The economic and political aspects, combined with the minimal state action in social and maximum capital, have strongly contributed to the expansion of the penal state.
