%A Gimenez, Melissa Zani %A Gimenez, Mariana Zani %D 2014 %T EDUCAÇÃO: UM DIREITO DE PERSONALIDADE DA CRIANÇA E ADOLESCENTE %K %X RESUMO: O presente trabalho tem por objetivo demonstrar a Educação como um direito de personalidade essencial, no sentido de transformação social, na vida da criança e do adolescente, principalmente por serem indivíduos em pleno desenvolvimento de sua moral e ética. O direito à educação encontrou maior respaldo na sociedade, por volta do Pós Segunda Grande Guerra, tendo como marco referencial o mundo grego e o romano. Visa demonstrar a importância do direito de personalidade, em especial à educação, como um dos atributos inerentes à própria condição humana como a vida, a imagem, e sendo amparado na Magna Carta pelo Princípio da Dignidade da Pessoa Humana. Nesse diapasão tratar do direito à vida, que é o cerne para a existência dos direitos de personalidade e, mais recentemente, o direito à educação, como uma das formas de promoção do homem, numa sociedade meritocrática, onde conhecimento assume características de poder, domínio e, ao mesmo tempo, de sobrevivência digna na sociedade que o indivíduo tenta subsistir.   Palavras-chave: Educação. Dignidade da pessoa humana.   ABSTRACT: The present work aims to show the education as a right to essential personality, in the sense of social transformation, in the lives of children and adolescents, mainly because they are individuals in full development of their morals and ethics. The right to education has found greater support in society, around the Post second World War, having as referential landmark the Greek and Roman world. Aims to demonstrate the importance of the right of personality, in particular to education, as one of the inherent attributes of the human condition as life itself, the image, and being supported on Magna Carta by the principle of Dignity of the human person.
