%A Tinoco, Ana Beatriz Passos %D 2014 %T DO NEOLIBERALISMO PROCESSUAL, DAS REFORMAS PROCESSUAIS SOB EMBLEMA DE “ACESSO À JUSTIÇA” E DA ATUAÇÃO DO AMICUS CURIAE NO PROCESSO OBJETIVO: UM BALANÇO CRÍTICO %K %X RESUMO: As reformas realizadas sob um rótulo de “Acesso à Justiça” apresentam-se pouco compreensíveis porque almejam a simplificação/rapidez procedimental, e o sistema processual vai requisitando, com o passar do tempo, devido ao aumento da complexidade das questões que circulam no contexto social, um exercício cada vez mais técnico dos operadores do Direito. Na verdade, são necessárias profundas transformações no sistema judiciário, ao que não se atende mudando apenas o direito substantivo e o direito processual. Faz-se imprescindível a criação de outra cultura jurídica e judiciária, a começar pela revolução desde a formação dos operadores do Direito, na qual domina uma cultura normativista, técnico-burocrática, assente na ideia da autonomia do Direito, como se este fosse um fenômeno totalmente independente/diferente do que ocorre na sociedade e em relação à mesma, apresentando figuração autônoma. Por outro lado, revela-se a importância do instituto amicus curiae no controle concentrado de constitucionalidade, terceiro que ingressa no feito pendente visando a enriquecer o debate judicial com diversas questões fáticas e jurídicas dispersas na sociedade. A sua atuação é, portanto, decorrência do princípio democrático, o que possibilita uma abertura procedimental, de legítimo acesso à Justiça, e rompe com a cultura formalista/normativista, a qual entende que o Direito é um campo fechado e autônomo, cujo desenvolvimento deve-se somente à letra fria da lei, isento das pressões sociais, incertezas e lacunas.   Palavras-chave: Neoliberalismo processual. Amicus curiae.   ABSTRACT: Reforms carried out under a label of "; Access to Justice"; presents little understandable why aim to simplify/speed procedural and procedural system will ordering , over time, due to the increased complexity of the issues circulating in the social context , an exercise increasingly technical operators of Law. In fact , major changes are needed in the judicial system , it not only meets changing the substantive law and procedural law . It is essential to the creation of other legal and judicial culture , starting with the revolution since the formation of legal operators , which dominates a culture normative , technical and bureaucratic , based on the idea of the autonomy of law, as if it were a phenomenon totally independent / different from what occurs in society and for the same features figuration unattended . On the other hand , reveals the significance of the amicus curiae in the concentrated control of constitutionality , which enters the third made ​​pending order to enrich the debate with several judicial fragmented legal and factual issues in society .
