Abstract

ABSTRACT: This article is about the history of the Constitution of the United States of Brazil of 1891, aiming to open a flank of analysis through its dialogue with the economic system that emerged in the immediate end of slavery. The research problem focuses on the contradiction between the constitutional text of the liberal economic model and the functioning of the economic system, which is apparently incompatible with those declarations. It starts from the hypothesis that the problem can not be analyzed in a relation of separation between theory and practice, but, on the contrary, through an interpenetration of these instances through the Law and the effective functioning of state institutions. The theoretical framework adopted in the text for the analysis is historical materialism and the authors that served as the basis for the research are inscribed in this context. The method chosen was the deductive and the article is divided into an introduction, analytical chapter, final considerations and bibliographic references.
