ATIVISMO JUDICIAL: PARA UMA EFETIVA PROTEÇÃO DOS DIREITOS FUNDAMENTAIS

RESUMO

O presente trabalho trata do perfil do juiz, principal membro do Poder Judiciário, no que diz respeito à efetivação e respeito aos direitos fundamentais. O perfil tradicional atribuído aos magistrados, entendidos como sujeitos passivos e neutros na relação jurídica de direito processual, não mais atende aos anseios da sociedade atual. Logo, ao exercerem a atividade jurisdicional, os juízes devem estar atentos à realidade social que os cerca, bem como à dinamicidade dos valores desta sociedade. Assim sendo, ao conduzir um processo judicial, o magistrado deve portar-se de maneira ativa e participativa, de modo que, mediante a fundamentação de suas decisões, possa demonstrar o respeito e atenção aos direitos fundamentais e conferir legitimidade à sua atuação.

ABSTRACT

This article deals with the judge’s profile, the Judiciary’s chief member, concerning the effectiveness and respect to the fundamental rights. The traditional profile attributed to the magistrates, seen as passive and neutral on the judicial process, no more assists the current society’s expectations. Therefore, when in the conduction of the judicial activity, the judges must be attentive to the social reality that surrounds them, as well as to the dynamics of the values of this society. Therefore, when conducting judicial proceedings, the magistrate must conduct themselves in an active and participatory way, so that, by the justification of their decisions, show respect and attention to fundamental rights and grant legitimacy to their actions.
