ACESSO À JUSTIÇA: ELEMENTOS PARA UMA REFLEXÃO SOBRE A JUSTIÇA PARTICIPATIVA

Resumo: A justiça pode ser contextualizada, de forma a ter-se que passar pelas categorias de justiça, no plano filosófico, elaboradas por Aristóteles, bem como poder-se-á falar em justiça no plano da prática forense, resumindo o acesso à justiça ao acesso aos tribunais. Para os Gregos a noção de direito estava ligada à idéia de justiça, no entanto, muitos doutrinadores afirmam que nos dias de hoje a justiça é o ideal do direito. Neste linear, precisou-se transcender as categorias de justiça aristotélicas, no sentido de buscar um novo paradigma de justiça, uma justiça mais participativa. Contudo, só haverá justiça participativa se, em primei­ro lugar, houver consciência de cidadania, através do conhecimento, por parte da sociedade, de seus direitos mais fundamentais (lembrando que o cidadão tam­bém tem deveres), bem como a postura combativa dos agentes do direito, ao me­nos tentando se livrar da conduta formalista. Desse modo, poder-se-á falar em justiça no plano do universal, bem como em acesso à justiça como elemento para concretização de uma justiça participativa, de inclusão e respeito aos direitos e garantias fundamentais de todo e qualquer cidadão.

Abstract: The justice can presented be, in way the terms that to pass goes the categories of justice, in the philosophical plan, elaborated by Aristotle, the well the we can speak in justice in the plan of the forensic practice, summarizing the access to the justice to the access to the tribunals. It goes the Greeks the right notion was linked to the idea of justice, however, many writers affirm that in the days today the justice i the ideal of the right. In this lineal one, he/she needed to transcend the categories of justice Aristotelian, in the sense of looking for a new paradigm of justice. However, there will only be justice participation if, in first place, there is citizenship conscience, through the knowledge, on the part of the society, of your more fundamental rights (reminding that the citizen also has du­ties), as well as the agents’ of the right combative posture. He/she gave way, it can be spoken in justice in the plan of the universal, as well as in access to the justice as element for materialization of a justice, of inclusion and respect to the rights and fundamental warranties of whole and any citizen.
