PRINCÍPIO CONSTITUCIONAL DA DIGNIDADE HUMANA E O DIREITO FRATERNO

Resumo

RESUMO
O presente artigo está ligado à linha de pesquisa Construção do Saber Jurídico, do Programa de Pós-Graduação em Direito do UNIVEM e ao Grupo de Pesquisa – GEP – Grupo de Estudos, Pesquisas, Integração e Práticas Interativas do qual os autores fazem parte. Os princípios constitucionais regem todo nosso ordenamento jurídico e as práticas jurisdicionais com alto grau de subjetividade, fazendo com que, sempre ao tomarmos atitudes e defendermos posicionamentos no âmbito jurídico, devemos passar pelo crivo dos princípios constitucionais, desde os expressos de forma direta na legislação, como aqueles que não o são claramente prescritos como o princípio da dignidade humana. A importância de se respeitar o princípio da dignidade humana está em afirmar o direito em seu papel de controlar a co-existência dos seres humanos de forma justa que, neste sentido, se refere na busca pela paz. Entendendo por justiça aquilo que permite ao ser humano ter seus direitos respeitados de forma eficaz, podemos considerar que um direito deve garantir à pessoa seu direito de “ser humano” no sentido de viver em paz, com dignidade em um ambiente fraterno. Na compreensão deste direito fraterno, devemos pressupor um direito não mais pensado como meramente punitivo, mas sim, com o direito com função promocional da pessoa humana. Enfim, a defesa por um direito fraterno é a garantia de que teremos uma ordem jurídica voltada para o ser humano na sua dignidade e, com isso, a conquista de um direito cada vez mais justo, atingindo a máxima eficácia no controle social pleno para o qual foi criado.

ABSTRACT
This article is on line connected to Knowledge Construction in Law, the Post Graduate Program in Law from the Univem and Research Group – GEP – Group of Studies, Research, Integration and Interactive Practices which the authors are members. The constitutional principles rule all our legal planning and judicial practices with a high degree of subjectivity, so that when we take the attitudes and defend positions in the legal sense, we must pass the scrutiny of constitutional principles, since the cast directly in the legislation, as those that are not clearly prescribed as the principle of human dignity. The importance of respecting the principle of human dignity is to assert the right in its role of monitoring the co-existence of human beings fairly, in this sense refers to the quest for peace. Understanding as justice what makes possible to a human have their rights respected effectively, we can consider that a law must guarantee the individual right to “human being” in the sense of living in peace with dignity in a fraternal environment. In understanding this right fraternal, we must assume a right no longer thought of as merely punitive, but with the right to promotional function of the human person. Finally, the defense by a fraternal law is the guarantee that we will have a law aimed at human beings in dignity and with it the conquest of a law more fair, reaching maximum effectiveness in social control for which full was created.
