A BUROCRATIZAÇÃO DO PODER JUDICIÁRIO COMO OBSTÁCULO AO ACESSO À JUSTIÇA

Resumo

RESUMO

O trabalho voltou-se para a análise crítica da burocratização do Poder Judiciário, cuja falácia corresponde a uma mazela processual, eis que, em virtude do formalismo exacerbado, resultante de uma burocracia colonial, leva ao afastamento do jurisdicionado do sistema judiciário, pois acabam enxergando-o como algo atemorizante e inacessível. Isso ocorre, pois, o ordenamento jurídico brasileiro, desde a sua formação, preocupou-se em atender aos interesses da classe detentora do poder, que corresponde a uma minoria privilegiada, em detrimento daqueles cidadãos economicamente mais débeis, daí a gritante desigualdade que reina até os dias de hoje e que impede o acesso à justiça. A par disso, voltou-se para o estudo das máculas processuais que impedem a prestação de uma tutela tempestiva, adequada e efetiva, já que, muitas vezes a forma impera ante a realidade social. Vislumbrou-se, como forma de superação, a urgente necessidade de mudança do paradigma racionalista, mantido pelo positivismo jurídico, eis que o acesso precário à justiça somente será possível de ser vencido, mediante a atuação conjunta e humanitária dos construtores do direito e magistrados, para que a justiça social prevaleça e não deixe desamparado àquele que mais necessita do Poder Judiciário.

ABSTRACT

The paper was turned to the critical analysis of the bureaucratization of the Judiciary Power, whose fallacy corresponds to one processual deformity, a time that, in virtue of the exacerbated formalism, resultant of a colonial bureaucracy, leads to the removal of the citizen from the judiciary system, here it is that they finish seeing it as something frightful and inaccessible. This occurs, therefore, the Brazilian legal system, since its formation, was worried in taking care of to the interests of the classroom detainer of the power, that corresponds to a privileged minority, in detriment of those economically weaker citizens, from there the clamorous inaquality that stay until the present and that hinders the access to justice. Along with this, it was turned to the study of you stain them processual that they hinder the installment of a timely guardianship, adjusted and accomplishes, since, many times the form reigns before the social reality. It was glimpsed, as overcoming form, the urgent necessity of change of the rationalist paradigm, kept by the juridical positivism, here it is that inacess to justice will only be possible of being looser, by means of the joint and humanitarian performance of the constructors of the right and magistrates, so that the social justice prevails and it does not leave abandoned to that more it needs the Judiciary Power.
